Dual-Track AI Economy Act of 2025
A BILL
To establish a dual-framework economic strategy that balances public access and private innovation in artificial intelligence, ensures equitable participation across sectors, and protects against the emergence of class-based technological disparity.
SECTION 1. SHORT TITLE
This Act may be cited as the "Dual-Track AI Economy Act of 2025."
SECTION 2. FINDINGS
Congress finds the following:
The development and deployment of AI technologies are concentrated within a small number of corporate entities, creating disproportionate influence and economic control.
Equal opportunity to benefit from AI is essential for social mobility, job creation, and democratic access.
A two-track national strategy is necessary to protect public interests while encouraging private sector growth and innovation.
SECTION 3. DEFINITIONS
As used in this Act:
Public AI Economy means AI systems and infrastructure funded, maintained, or deployed under public initiatives or nonprofit programs.
Private AI Economy means AI products, services, and enterprises developed, owned, and operated by private sector firms.
AI Fairness Audit means an independent review process to assess bias, accessibility, and compliance with national AI equity laws.
SECTION 4. PUBLIC AND PRIVATE TRACK DESIGNATION
(a) The Federal AI Constitutional Authority (FACA) shall establish two concurrent tracks of national AI economic development:
(1) Public Equity Track
Includes subsidized AI access terminals, public data models, and non-profit innovation hubs.
Focuses on underserved areas, such as rural communities, inner cities, and tribal lands.
(2) Private Innovation Track
Supports startups and enterprises through AI-specific tax credits, grants, and public-private partnership opportunities.
Encourages competition, market-driven innovation, and export competitiveness.
(b) FACA shall maintain a balance report every fiscal year to ensure proportional development across both tracks.
SECTION 5. AI FAIRNESS INCENTIVES
(a) Private firms participating in federal AI programs must undergo annual AI Fairness Audits.
(b) Firms that demonstrate compliance with transparency, bias reduction, and access equity standards shall be eligible for the following:
Expanded R&D tax credits
Preferential federal contract access
Public endorsement under the "American AI Trustmark"
SECTION 6. PROHIBITION ON CLASS-BASED AI DISPARITY
(a) No AI system operating in the U.S. may restrict access, performance, or outcomes based on income, location, race, or other protected class characteristics.
(b) FACA is authorized to investigate and penalize violations of equity in access or outcomes.
SECTION 7. FUNDING AND IMPLEMENTATION
(a) This Act shall be funded through allocations from the American Reboot Act of 2025 and associated DOGE Plan savings.
(b) No new income, payroll, or corporate taxes shall be levied.
(c) Full implementation shall occur within three years of enactment.
SECTION 8. RULEMAKING AND OVERSIGHT
(a) FACA shall issue implementing regulations within 12 months.
(b) Annual public reporting shall be made available through the Office of AI Access & Inclusion.
(c) Congress shall receive progress reports on parity, audit compliance, and economic impact.
SECTION 9. SEVERABILITY
If any provision of this Act is held invalid, the remainder shall remain in effect.
